RAB® Prize Draw.

The Rab® Prize Draw is promoted by BASF plc, PO Box 4, Earl Road, Cheadle Hulme, SK8 6QG.

 Entry Requirements

  • The Rab® Prize Draw will be open from 00:01 on 21.08.19 and close at 23:59 on 30.08.19 inclusive (the “Promotional Period”).
  • Entrants permitted to enter The Rab® Prize Draw are farmers and agronomists who are residents of the UK and aged 18 years or over (“Entrants”). Employees of the Promoter, their families, agents or any third party directly associated with administration of the Prize Draw are not permitted to enter.
  • No purchase necessary. Only one entry per person.

  • Entrants can enter the Rab® Prize Draw by:

 Entrants who are not members of Real Results Circle:

  • Entrants who are not a member of the Real Results Circle will be required to become a member of Real Results Circle and enter the Prize Draw within the Promotional Period.
  • Entrants will be required to click on the Twitter, Facebook or Instagram post link; or
  • Click on the website header banner link to sign up as a member of the Real Results Circle. Website link be found https://basfrealresults.co.uk/.

 Entrants who are members of Real Results Circle:

  • Entrants will receive an email with a link to click to enter automatically. Entrants that are logged into their Real Results Circle account will automatically enter the Prize Draw when clicking the link. Entrants not logged into the Real Results Circle account will be required to log and will then be automatically entered.
  • The Promotor accepts no responsibility for entries not successfully completed due to a technical fault of any kind.

 The Prizes:

  • The prizes will consist of 10x Rab® Downpour Plus Jackets worth £130 (the “Prizes”).
  • The winners of the Prize Draw will be chosen by random draw supervised by an independent person on 13.09.19.
  • Prizes will be provided to 10 winners selected at random.
  • The prize for the winner is non-exchangeable, non-transferable and no cash alternative is offered.
  • The Promoter reserves the right to replace the prizes with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control make it necessary.

Winner announcement

  • The promoter will notify the winners by 27.09.19 following the Prize Draw by email or telephone (using details provided at entry) and the winner must provide a postal address to claim their prize. If a winner does not respond to the Promoter within 10 days of being notified by the Promoter, then the winner’s prize will be forfeited, and the Promoter will be entitled to select another winner in accordance with the process described above.

Claiming the prizes

  • Each of the winners will be provided with the prize by post or personal presentation from their local BASF representative.

Liability

  • BASF is not liable for any loss or damage suffered as a result of this Prize Draw (except that which cannot be excluded by law).

Personal data

  • Personal data supplied during the course of this promotion will be used by BASF solely for the purpose of this promotion and may be passed on to third party suppliers only insofar as required for fulfilment/delivery/arrangement of the prize.

Miscellaneous

  • The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
  • The Promoter reserves the right to suspend, cancel or amend the Prize Draw where it becomes necessary to do so.
  • The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners and if applicable, copies of their winning entries, to anyone who emails basf@basfrealresults.co.uk within one month after the closing date stated in condition 1. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter. In such circumstances, the Promoter must still provide the information and winning entry to the Adverting Standards Authority on request.
  • Entrants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry or refuse to award a prize to anyone in breach of these terms and conditions.
  • These terms and conditions shall be governed by English law, and the parties submit to the jurisdiction of the courts of England and Wales.

Winter OSR Establishment Risk Share Programme 2019 – Standard InVigor Programme

  1. The Winter OSR Establishment Risk Share Programme (the “Programme”) is promoted by BASF plc, company number: 667980, registered office: PO Box 4, Earl Road, Cheadle Hulme, SK8 6QG and applies to BASF InVigor winter oilseed rape hybrids listed in Annex 1 (“InVigor Winter OSR Seed”)
  2. How to enter
  • The Programme is offered as a standard feature of the InVigor Winter OSR Seed product range.
  • There is no additional requirement for entry, when purchasing InVigor winter OSR Seed in 2019 you are automatically eligible for the pack(s) purchased and terms and conditions of the Programme will be available on the BASF website.
  • A link to the BASF claim page will be supplied with the Programme terms and conditions.
    1. InVigor Winter OSR Establishment Programme
      1. A farm business (“Farm Business”) which has purchased InVigor Winter OSR Seed and thereby entered the Programme shall:
        • On or before 22nd September 2019 plant the InVigor Winter OSR Seed according to the field conditions and at a minimum sowing rate of 40 viable seeds per square metre.
        • Use best current agricultural practice in the planting, agronomy and protection of the crop and follow product manufacturers guidelines at all times.
      2. Subject to the Farm Business’s compliance with paragraphs 3 and 4, BASF, via its agents for InVigor, will re-imburse the Farm Business the Programme value of £30 per Ha (based on a notional 3Ha) purchased if:
        • prior to 31st October 2019 the winter oilseed rape crop sown with said InVigor hybrid seed (minimum 3Ha block) has failed (namely a decision has been made to re-drill); and
        • the grower decides / Agronomist recommends that the sown field(s) should be re-planted with an eligible alternative crop as listed in Annex 2 (“Alternative Crop”);
          • the grower decides / Agronomist recommends that the failed area is left fallow (minimum 3 hectare block) and agrees to remove any remaining OSR plants, either by chemical or cultural methods.
          • The Programme will not be payable in respect of any area which is patch drilled or if a block of less than 3 hectares is re-drilled or left fallow
    2. Making a claim
    1. To make a claim for the payment of the Programme the Farm Business shall:
      • On or before 31st October 2019 register the claim on the BASF website giving all the requested information which shall include:
    1. Proof of the valid InVigor Winter OSR Seed purchase; and
    2. Agronomist recommendations; and
    3. Claim Field location(s).
      1. Provide any evidence reasonably requested by BASF to validate the claim and satisfy itself that all conditions have been met, such evidence to be provided by the Farm Business within 10 working days of BASF’s request or its subcontractor.
      2. To verify legitimacy of any claim BASF or its subcontractor may (1) visit the Farm Business and inspect the claim fields as BASF considers reasonably necessary (and the Farm Business grants an irrevocable licence to enter the Farm Business premises and claim fields accordingly), and/or (2) monitor the claim fields by satellite throughout the growing season of winter oilseed rape, and all such inspection reports and records shall be deemed to be conclusive evidence.
      3. If, once all information requested by BASF has been provided, BASF is satisfied that the claim by the Farm Business for the Programme is valid and meets all the conditions, BASF shall pay the relevant Programme value to the Farm Business by way of credit to the Farm Business’s account via the InVigor agent or BASF subcontractor:
      4. In November 2019 in the case of claims verified before 31 October 2019; or

    ii In December 2019 for all other verified claims. Late, incomplete or corrupt registrations or claims not fulfilling all the conditions will not be accepted. No responsibility can be accepted for lost registrations or claims and proof of despatch will not be accepted as proof of receipt.

The personal information provided by or on behalf of the Farm Business or the agronomist will be used by BASF only for the purpose of this Programme and may only be used or passed on to third party suppliers as required for verification of entitlement to and payment of the Programme value or as otherwise necessary for the fulfilment by BASF of its obligations hereunder.

    2. Miscellaneous
      1. BASF shall only be required to pay the Farm Business the Programme value on and subject to these Terms & Conditions and, except to the extent that liability cannot be excluded or limited by law, BASF has no liability for any losses whatsoever, however arising, as a result of, or in connection with, the failure of Winter oilseed rape in a registered field.
      2. BASF may withdraw the Programme at any time, but such withdrawal shall not apply to any Farm Business validly registered for the Programme in accordance with these terms and conditions prior to the date of such withdrawal.
      3. These terms & conditions (and any document referred to herein) contain the entire agreement between BASF and the Farm Business in relation to the Programme and they supersede all previous communications, agreements or understandings of whatever nature relating thereto.
      4. These terms and conditions shall be governed by English law, and the parties submit to the jurisdiction of the courts of England and Wales.

Winter OSR Establishment Risk Share Programme 2019 – Herbicide Programme

  1. The Winter OSR Establishment Risk Share Programme (the “Programme”) is promoted by BASF plc, company number: 667980, registered office: PO Box 4, Earl Road, Cheadle Hulme, SK8 6QG and applies to BASF Winter OSR herbicides listed in Annex 1 (“BASF Winter OSR Herbicides”).
  2. How to enter
    1. BASF OSR Herbicide Establishment Risk Share Programme
      1. A farm business (“Farm Business”) which has purchased a BASF Winter OSR Herbicide and thereby qualified for the Programme shall:
        • On or before 22nd September 2019, have planted a winter oilseed rape crop according to good agronomic practice and agronomist recommendations; and
        • Have applied a qualifying BASF Winter OSR Herbicide according to the agronomist recommendations.
      2. Subject to the Farm Business’s compliance with paragraphs 3 and 4, BASF, will re-imburse the Farm Business the invoice value of the herbicide applied to the failed area (minimum 3ha), up to a value of £50/ha if:
        • prior to 31st October 2019 the Farm Business makes a claim under the Programme providing all required information as detailed under 4. a – c.
          1. The Programme is offered as a standard feature of the BASF Winter OSR herbicide portfolio.
          2. There is no additional requirement for entry, when purchasing a BASF Winter OSR Herbicide in 2019 you are automatically eligible.prior to 31st October 2019 the winter oilseed rape crop treated with a BASF Winter OSR Herbicide has failed (namely a decision has been made to re-drill); and
          3. the Farm Business decides / Agronomist recommends that the sown field(s) should be re-planted with an eligible alternative crop as listed in Annex 2 (“Alternative Crop”); orthe grower decides / Agronomist recommends that the failed area is left fallow (minimum 3 hectare block) and agrees to remove any remaining OSR plants, either by chemical or cultural methods.
          4. The Programme will not apply in respect of any area which is patch drilled or if a block of less than 3 hectares is re-drilled or left fallow.
    1. Making a claim
      1. To make a claim for payment under the Programme the Farm Business, shall:
        • On or before 31st October 2019 register the claim for a minimum of 3ha on the BASF website giving all the requested information which shall include:
    1. Proof of the valid BASF Winter OSR Herbicide Purchase and
    2. Application records and agronomist recommendations; and
    3. Claim field location(s).
      1. Provide any evidence reasonably requested by BASF or a third-party intermediary to validate the claim and satisfy itself that all conditions have been met, such evidence to be provided by the Farm Business within 10 working days of BASF’s request or its subcontractor.
      2. To verify legitimacy of any claim BASF or its subcontractor may (1) visit the Farm Business and inspect the claim fields as BASF considers reasonably necessary (and the Farm Business grants an irrevocable licence to enter the Farm Business premises and claim fields accordingly), and/or (2) monitor the claim fields by satellite throughout the growing season of winter oilseed rape and the re-drilled crop in the failed field, and all such inspection reports and records shall be deemed to be conclusive evidence.

The Innovation Offer – Terms and Conditions

  1. The Innovation Offer is promoted by BASF plc, company number: 667980, registered office: PO Box 4, Earl Road, Cheadle Hulme, SK8 6QG.

How to enter

  1. The Innovation Offer is only open for entry by farm businesses whose registered office or principal place of business is in England, Scotland or Wales (“Farm Business”).
  2. To enter the Innovation Offer the Farm Business must satisfy all of the following conditions:
    • Register as a participant in the Innovation Offer on the BASF Real Results website including all the requested information [Find out more], following which registration a unique serial number and link to the BASF Companion app will be emailed to the Farm Business.
    • Download and activate the BASF Companion app, available free of charge from either Apple App Store or from Google Play.
    • Between 00.00 18/3/2019 and 23.59 30/6/2019 purchase 50 or more litres of BASF Adexar Fungicide and/or Librax Fungicide (“Valid Product Purchase”).
    • Prior to 30 June 2019, use the BASF Companion app to scan the 2D bar code found on the container of the Valid Product Purchase. Any Valid Product Purchase scanned after 30 June 2019 will not be counted towards the volumes purchased by that Farm Business for the purposes of the Innovation Offer.
    • Use the Valid Product Purchase on its farm and qualify such usage via the BASF Companion app by 30 June 2019.
  3. A Farm Business which has validly entered the Innovation Offer by satisfying all the conditions in paragraph 2(b) shall qualify for one entry into each of one, two or three tiers of the prize draw dependent on the volumes of its Valid Product Purchases which are used and registered by it under paragraphs 2(b)(iv) and (v):
    • Tier 1: 40 – 100 litres – for entry into the draw to win a pair of Miendl Walking Boots. 100 pairs to be won.
    • Tier 2: More than 100 litres – for entry into the draw to win one place on the Innovation Study Tour to Europe. 40 Innovation Study Tour places to be won.
    • Tier 3: Purchase an additional 40 Litres and receive one additional entry into the draw for a place on the Innovation Study Tour Europe. for every additional 40L you get an extra entry into the Innovation Study Tour Europe.
  4. The draw shall take place on or before 10 July 2019 when winners of each tier of the prize draw will be chosen from the qualifying entrants by random draw supervised by an independent person. The decision of the independent draw is final, and no correspondence will be entered into.
  5. The Promoter reserves the right to request that winners evidence usage of the Valid Product Purchase in accordance with paragraph 2(b)(v) by providing copies of their field records and their purchase records within 5 working days of the request. This validation will be requested randomly from the pool of winners.
  6. There is no cash alternative for the prizes.
  7. The Promoter reserves the right to replace the prizes with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control make it necessary.
  8. Late, incomplete or corrupt entries or entries not fulfilling all the conditions of paragraph 2(b) will not be accepted. No responsibility can be accepted for lost entries and proof of despatch will not be accepted as proof of receipt.
  9. The Innovation Study Tour prize is available on the stated dates only.

Free Gift

  1. All Farm Businesses which satisfy the conditions in paragraphs 2(b) (i), (ii), (iii) (iv) and (v) and between 00.00 01/02/2019 and 23.59 30/6/2019 purchase 10 or more litres of BASF Adexar Fungicide and/or Librax Fungicide shall receive a free gift.
  2. Free gifts will be provided by post by 30 July 2019.
  3. Only one free gift will be provided per Farm Business.

Winner announcement

  • The Promoter will notify the winners as soon as practicable via the contact details given at registration, and in any event within 10 days of the draw.
  • The winners of the Innovation Offer will be announced on the Real Results website in August 2019.
  • A Farm Business which wins a place on the Innovation Study Tour shall within 10 days of notification nominate one person to receive the prize, such person to be an employee or manager of the Farm Business and aged 18 or over. Once a person has been nominated in accordance with this paragraph, the Innovation Study Tour place cannot be transferred by that person. For the avoidance of doubt the Farm Business cannot nominate any employee of the Promoter or an employee’s family.

Claiming the prizes

  1. Each of the winners will be provided with the prize by post or personal presentation from their local BASF representative, in the case of the prizes for tier 1 by 30 July 2019.
  2. The Promoter reserves the right to offer the prize of the Innovation Study Tour to Europe to the next eligible winner (drawn independently and at random using the same process as outlined in paragraph 2d) if within 10 days of the Announcement Date the winner:
      • cannot be contacted via the contact details given at registration;
      • has not confirmed acceptance of the prize in response to an email or call via the contact details given at registration; or
      • is not available to go on the Innovation Study Tour to Europe; or
      • has not validly nominated a person in accordance with paragraph 4(c); or
      • has not provided the field records referred to in paragraph 2(e); or
      • has not provided the purchase records referred to in paragraph 2(e); or
      • the field records provided pursuant to paragraph 2(e) do not provide evidence satisfactory to the Promoter that the Valid Product Purchases have all been used on the winner’s farm; or
      • the person nominated has not provided the evidence required in accordance with paragraph 2(e).

Liability

    • Events may occur that render the prize draw itself or the awarding of the prize or gift impossible due to reasons beyond the control of the Promoter and accordingly the Promoter may at its absolute discretion vary or amend the promotion and the Farm Business agrees that no liability shall attach to the Promoter as a result thereof.
    • The Promoter is not liable for any loss or damage suffered as a result of the Innovation Offer (except that which cannot be excluded by law).
    • The Innovation Study Tour to Europe Prize includes return flights from the UK to Europe, hotel accommodation, meals and visits as laid out in the Innovation Study Tour Itinerary.
    • Any costs or expenses not expressly included in the Innovation Study Tour pursuant to these terms and conditions including without limitation, excess baggage, car parking charges, drinks, transfers to and from Heathrow, spending money, any excursions which are not on the itinerary, the cost or arrangement of any applicable passenger visas or injections, or travel insurance, which will be the sole responsibility of the winner.
    • Prior to 2 November 2019 the person nominated by the winner of the Innovation Study Tour to Europe must provide evidence to the Promoter that he/she has a passport valid for three months beyond the intended departure date, travel insurance (including, without limitation, adequate cover for health) and, if required, a valid visa and evidence of any injections.
    • The Innovation Study Tour to Europe prize may be subject to further terms and conditions which will be confirmed when the prize is awarded.

Personal data

  • The participants personal information, and the personal information of the person nominated to win the prize in accordance with paragraph 4(c) will be used by BASF for the purpose of this Innovation Offer promotion and may be passed on to third party suppliers as required for fulfilment/delivery/arrangement of the prize.
  • Participants personal information may also be used for other purposes as defined in BASF’s privacy policy: https://basfrealresults.co.uk/privacy/
