OSR State of the Nation Survey 2019 – Terms and Conditions

  1. The OSR State of the Nation Survey is promoted by BASF, PO Box 4, Earl Road, Cheadle Hulme, SK8 6QG.
  2. How to enter
    1. The Survey and Prize Draw will be open from 9.00am on the 18th January 2019 to midnight on the 28 February 2019 inclusive.
    2. The Survey and Prize Draw is only open to farmers and agronomists who have grown or advised on winter oilseed rape in the UK in the last three years.
    3. The Survey and Prize Draw is only open to residents of the UK aged 18 years or over.
    4. No purchase necessary. Only one entry per person.
    5. To enter the Prize Draw:
      • Complete the OSR State of the Nation Survey online.  Entries are submitted automatically upon completion before the Closing Date.
    6. The Promoter will not accept:
      • Responsibility for Surveys that are lost, mislaid, damaged or delayed in transit, regardless of cause.
    7. All Surveys must be received by the Promoter by 28 February by no later than midnight on the Closing Date. All Surveys received after the Closing Date are automatically disqualified.
    8. By submitting a Survey, you are agreeing to be bound by the terms and conditions.
  3. The prizes
    1. The first 500 entrants from who the Promoter receives a completed Survey before the closing date will receive a £5 Amazon voucher.
    2. 5 winners will each receive £50 worth of Amazon vouchers.
    3. The winners of the Prize Draw will be chosen by random draw supervised by an independent person on 8th March 2019.
    4. There is no cash alternative for the prizes.
    5. The Promoter reserves the right to replace the prizes with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control make it necessary.
    6. Prizes will be limited to the first 500 entrants.
  4. Winner announcement
    1. The Promoter will contact the winners personally as soon as practicable after the Announcement Date.
    2. A list of the winners will be made available upon request but only in the event that the entrant has provided consent to share this information.
  5. Claiming the prizes
    1. Each of the winners will be provided with the prize by email.
    2. If the winners cannot be contacted or are not available, or have not claimed their prizes within 10 days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the Surveys that were received before the Closing Date.
  6. Liability
    1. BASF is not liable for any loss or damage suffered as a result of this prize draw (except that which cannot be excluded by law).
  7. Personal data
    1. Personal data supplied during the course of this promotion will be used by BASF in accordance with the communication permissions selected by the entrant and for the purpose of providing the prize.  Personal data may be passed on to third party suppliers only insofar as required for fulfilment/delivery/arrangement of the prize.

  8. Miscellaneous
    1. The Promoter reserves the right to suspend, cancel or amend the Prize Draw where it becomes necessary to do so.
    2. These terms and conditions shall be governed by English law, and the parties submit to the jurisdiction of the courts of England and Wales.

The Innovation Offer – Terms and Conditions

  1. The Innovation Offer is promoted by BASF plc, company number: 667980, registered office: PO Box 4, Earl Road, Cheadle Hulme, SK8 6QG.
  2. How to enter
    1. The Innovation Offer is only open for entry by farm businesses whose registered office or principal place of business is in England, Scotland or Wales (“Farm Business”).
    2. To enter the Innovation Offer the Farm Business must satisfy all of the following conditions:
      1. Register as a participant in the Innovation Offer on the BASF Real Results website including all the requested information [register here], following which registration a unique serial number and link to the BASF Companion app will be emailed to the Farm Business.
      2. Download and activate the BASF Companion app, available free of charge from either Apple App Store or from Google Play.
  • Between 00.00 16/4/2018 and 23.59 30/6/2018 purchase 50 or more litres of BASF Adexar Fungicide and/or Librax Fungicide (“Valid Product Purchase”).
  1. Prior to 30th June 2018, use the BASF Companion app to scan the 2D bar code found on the container of the Valid Product Purchase. Any Valid Product Purchase scanned after 30th June 2018 will not be counted towards the volumes purchased by that Farm Business for the purposes of the Innovation Offer.
  2. Use the Valid Product Purchase on its farm and qualify such usage via the BASF Companion app by 30th June 2018.
  1. A Farm Business which has validly entered the Innovation Offer by satisfying all the conditions in paragraph 2(b) shall qualify for entry into one or two tiers of the prize draw according to the volumes of its Valid Product Purchases which are used and registered by it under paragraphs 2(b)(iv) and (v):
    1. Tier 1: 50 – 140 litres – for entry into the draw to win a pair of Le Chameau Wellingtons. 150 pairs to be won.
    2. Tier 2: More than 150 litres – for entry into the draw to win one place on the Innovation Study Tour to New Zealand. 15 Innovation Study Tour places to be won.
  2. The draw shall take place on or before 18th July 2018 when winners of each tier of the prize draw will be chosen from the qualifying entrants by random draw supervised by an independent person. The decision of the independent draw is final and no correspondence will be entered into.
  3. The Promoter reserves the right to request that winners evidence usage of the Valid Product Purchase in accordance with paragraph 2(b)(v) by providing copies of their field records and their purchase records within 5 working days of the request. This validation will be requested randomly from the pool of winners.
  4. There is no cash alternative for the prizes.
  5. The Promoter reserves the right to replace the prizes with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control make it necessary.
  6. Late, incomplete or corrupt entries or entries not fulfilling all the conditions of paragraph 2(b) will not be accepted. No responsibility can be accepted for lost entries and proof of despatch will not be accepted as proof of receipt.
  7. The Innovation Study Tour prize is available on the stated dates only.

 

  1. Free Gift

 

  1. All Farm Businesses which satisfy the conditions in paragraphs 2(b) (i), (ii), (iv) and (iv) and between 00.00 19/3/2018 and 23.59 30/6/2018 purchase 10 or more litres of BASF Adexar Fungicide and/or Librax Fungicide shall receive a Mighty Mug.
  2. Mighty Mugs will be provided by post by 30th July 2018.
  3. Only one Mighty Mug will be provided per Farm Business.

 

  1. Winner announcement
    1. The Promoter will notify the winners as soon as practicable via the contact details given at registration, and in any event within 10 days of the draw.
  1. The winners of the Innovation Offer will be announced on the Real Results website in August 2018.
  2. A Farm Business which wins a place on the Innovation Study Tour shall within 10 days of notification nominate one person to receive the prize, such person to be an employee or manager of the Farm Business and aged 18 or over. Once a person has been nominated in accordance with this paragraph, the Innovation Study Tour place cannot be transferred by that person. For the avoidance of doubt the Farm Business cannot nominate any employee of the Promoter or an employee’s family.

 

  1. Claiming the prizes
    1. Each of the winners will be provided with the prize by post or personal presentation from their local BASF representative, in the case of the prizes for tier 1 by 30th July 2018.
    1. The Promoter reserves the right to offer the prize of the Innovation Study Tour to New Zealand to the next eligible winner (drawn independently and at random using the same process as outlined in paragraph 2d) if within 10 days of the Announcement Date the winner:
      1. cannot be contacted via the contact details given at registration;
      2. has not confirmed acceptance of the prize in response to an email or call via the contact details given at registration; or
      3. is not available to go on the Innovation Study Tour to New Zealand; or
      4. has not validly nominated a person in accordance with paragraph 4(c); or
      5. has not provided the field records referred to in paragraph 2(e); or
      6. has not provided the purchase records referred to in paragraph 2(e); or
      7. the field records provided pursuant to paragraph 2(e) do not provide evidence satisfactory to the Promoter that the Valid Product Purchases have all been used on the winner’s farm; or
      8. the person nominated has not provided the evidence required in accordance with paragraph 2(e).
  1. Liability
    1. Events may occur that render the prize draw itself or the awarding of the prize or gift impossible due to reasons beyond the control of the Promoter and accordingly the Promoter may at its absolute discretion vary or amend the promotion and the Farm Business agrees that no liability shall attach to the Promoter as a result thereof.
    1. The Promoter is not liable for any loss or damage suffered as a result of the Innovation Offer (except that which cannot be excluded by law).
    2. The Innovation Study Tour to New Zealand Prize includes return business class flights London Heathrow/New Zealand (outward on 24/11/2018 and return on 7/12/2018, arriving on 8/12/18), hotel accommodation, meals and visits as laid out in the Innovation Study Tour Itinerary.
    3. Any costs or expenses not expressly included in the Innovation Study Tour pursuant to these terms and conditions including without limitation, excess baggage, car parking charges, drinks, transfers to and from Heathrow, spending money, any excursions which are not on the itinerary, the cost or arrangement of any applicable passenger visas or injections, or travel insurance, which will be the sole responsibility of the winner.
    4. Prior to 2nd November 2018 the person nominated by the winner of the Innovation Study Tour to New Zealand must provide evidence to the Promoter that he/she has a passport valid for three months beyond the intended departure date, travel insurance (including, without limitation, adequate cover for health) and, if required, a valid New Zealand visa and evidence of any injections.
    5. The Innovation Study Tour to New Zealand prize may be subject to further terms and conditions which will be confirmed when the prize is awarded.
  1. Personal data
    1. The participants personal information, and the personal information of the person nominated to win the prize in accordance with paragraph 4(c) will be used by BASF only for the purpose of this Innovation Offer promotion and may be passed on to third party suppliers only insofar as required for fulfilment/delivery/arrangement of the prize.
